Three top judges in Scotland rejected an appeal to block the plans for the Western Peripheral bypass.
The plans which cost a projected £400 million were first lodged in December 2009 but were put on hold after a public enquiry.
Plans are strongly supported by local businesses in the Mearns area as well as local MSP’s such as transport spokesman Graeme Clark who believes that as well as being good news for congestion in Aberdeen “it is good news for the construction industry”.
The main opposition to the bypass has been from protest group Road Sense and their chairman William Walton who believes that the road plan is “fundamentally flawed and unjust”.
The route is set to stretch 28 miles and will help relieve congestion around the area and others around North East Scotland, creating a fast link to Stonehaven.
Road Sense are considering an appeal to the Supreme Court.
